Abstract:
»Does international law matter? Does it have any impact on behavior? Furthermore, does more legalization, meaning the increase in the precision, obligation and delegation of international laws bringing about a higher probability of enforcement induce more change on the ground? By looking at the track record of two related practices of war, which were prohibited by highly legalized regimes 100 years apart, this article seeks to address this question about the relationship between legalization and compliance. Comparing these two prohibitions reveals that law and particularly enforcement matters in terms of inducing compliance. However, the temporal gap between the two prohibitions also points to another important variable: time. Even for the most legalized regimes, it takes time for the laws to be internalized hence complied which should make us think about the significance of norm internalization as an important part of the legalization process.«
